Upon deposit or commencing work, whichever occurs first, the authorised Client accepts these terms and conditions, and the payment terms, scope, exclusions and job details as described on this page and within Invoicing.
Items not specifically listed are deemed exclusions and any change in scope requires written submission (Brighton Painting is not liable for costs resulting from exclusions or variations). Written instruction will override verbal instruction.
Adjustments to scope, variations, delays or the unforeseeable are priced at an hourly rate plus cost.
Staircases (including but not limited to handrails, balustrades, spindles/balusters, newel posts, stringers, returns, and associated detailing) are excluded from standard trim painting unless specifically listed and priced separately.
Due to the increased complexity, access requirements, preparation time, and higher finish expectations, they are treated as a distinct scope of work. Where requested, painting can be quoted as a separate item following inspection.
Allowances include reasonable relocation and protection of furniture within rooms. Extensive furniture movement or full room clearance will incur additional costs.
We endeavour to provide quality services however work does not include replacement or full restoration to substrates hence final finish may reflect pre-existing imperfections.
We cannot be held responsible for outcome where tools or materials (including paints) are supplied by client.
Under consumer law “Goods and services must be provided with due care and skill, fit for purpose, and of acceptable quality based on what a reasonable person would expect.”
All work is inspected from a standing position at approximately 1.5 metre distance and under normal lighting conditions, in line with industry guidelines and fair practice. Brighton Painting reserves photographic rights.
Brighton Painting offers a 1 day post-completion defect liability period for small 1-7 day jobs and a 3 day post-completion defect liability period for jobs 8 days or more. Claims made in bad faith and minor cosmetic issues that do not materially affect the finish, durability, or functionality of the work will not be treated as defects for the purposes of withholding payment. Provided full invoice payment has been made, any qualifying issues will be addressed promptly.
Completion is defined as all work as described in the agreed scope having been carried out to a professional industry standard.
All prices are inclusive of GST unless stated otherwise
Payments can be made via bank transfer, credit card, or cash. All payments are recorded for GST compliance; cash payments do not reduce the total price or tax.
Withholding progress payments gives Brighton Painting the right to immediately suspend works without penalty or liability. Any late payments incur fees following 14 days of non payment at 2.5% unless otherwise agreed in writing.
Payments are due on receipt. Brighton Painting may choose to delay, pause or withhold services should payments not be made (payments later than 14 days after due date will incur a 5% weekly compounding fee unless otherwise agreed).
